Robert F. Kennedy Jr.’s campaign announced on Monday that they are considering taking legal action against Nevada regarding his independent candidacy petition. This comes after CBS News reported that the state’s demographic makeup would benefit a Democratic candidate.

The Kennedy campaign claimed that the Democratic Party invented a new rule to invalidate his Nevada signatures. But Nevada’s requirement for a vice presidential candidate to be named in an independent candidate’s petition has been on the books since 1993.

“After gathering all necessary signatures in Nevada, Paul Rossi, attorney for the Kennedy campaign’s ballot access, claims that the DNC’s enforcers and their allies in the Nevada Secretary of State’s office are creating a new requirement for the petition without any legal justification,” stated Rossi. “The Nevada law does not mandate the inclusion of the VP on the petition, and the petition itself does not provide a space for a VP.”

According to the statutes, an independent candidate’s petition for candidacy must also include a chosen nominee for the position of Vice President.

The records obtained from the Nevada location disclosed that Kennedy submitted only his own name on his nomination application, without a partner, which goes against the regulations and could potentially render the signatures collected in the state as invalid.

The staff at the secretary of state’s office admitted to providing Kennedy with incorrect information.

This morning, our office became aware that a Secretary of State employee had given incorrect instructions to an independent presidential campaign. This mistake will be addressed appropriately. Our statement to CBS News clarifies that the mistake and any follow-up instructions were not done with the intention of helping or hurting any political party or candidate.

However, the office also stated that even though there was a mistake, it was the responsibility of Kennedy’s campaign to abide by the law.

“When a government organization interacts with a member of the community and provides an ambiguous or incorrect response to an inquiry, courts in Nevada have made it evident that the organization cannot adhere to the statements made by its employee if doing so would contradict the law,” stated the office.

Kennedy is currently listed as a candidate in the state of Utah. However, his team has gathered sufficient signatures to meet the requirements for ballot access in multiple other states. On Tuesday in Oakland, Kennedy intends to announce his chosen vice presidential candidate.
